No: Spain’s non-lucrative residence route does not authorise you to carry out work or professional activity, including remote work for an overseas employer. Being paid in the United States or United Kingdom, using a foreign bank account, or having no Spanish clients does not turn a job into passive income.
This distinction matters before you choose a visa. The non-lucrative route is designed for residence without gainful activity; the digital nomad route is designed for qualifying international remote work. A person can have enough savings for the first route and still need the second because they intend to keep working.
The Washington consulate’s non-lucrative guidance expressly excludes work performed remotely or online.
Why “my employer is abroad” does not solve the problem
The relevant issue is the activity you perform while residing in Spain, not simply where the employer is incorporated or where your wages arrive. Writing reports, attending client calls, developing software or managing a team remains work when done from your Spanish home.
The Spanish consular description is explicit: the non-working residence visa allows residence without any gainful work or professional activity and does not constitute a work permit. Do not rely on informal accounts of somebody who obtained a visa while maintaining an overseas job. An individual approval does not establish a general permission to work.
For employed remote workers, start instead with the Spain digital nomad visa requirements and legal service. That route has its own evidence and social security conditions; it is not enough to substitute the application form.
What about a few hours of consulting each month?
Occasional paid consulting is still professional activity. The non-lucrative visa is not a low-hours work permit, and a foreign client is not an exemption. If you plan to advise clients, invoice for projects or deliver online services, describe that honestly when assessing the appropriate residence route.
The same applies to freelance platforms, tutoring, paid coaching and contract design or development work. Calling a payment “supplemental income” does not answer the immigration question. What matters is whether you perform the underlying activity, and whether the residence authorisation permits it.
Passive income and active business are different
Pensions, accessible savings and genuinely passive investment returns can be relevant to a non-working financial profile. But a revenue stream is not passive merely because it arrives automatically or through a company you own.
A useful first question is whether the money requires you to provide current services. Dividends received as a passive shareholder are different from actively managing staff, acquiring customers and delivering work for the company. Receiving rent as an investor is different from personally operating a hospitality business.
There is no universal label that settles every case. If you have a company, set out your actual role: directorship, management, client services, decision-making and remuneration. An adviser needs the substance of the arrangement, not just the name of the bank transfer.
Four hypothetical profiles and the questions they raise
A retired US couple living on retirement benefits and savings. The non-lucrative route may fit the intended non-working lifestyle, subject to sufficient means and the other requirements. Their pension evidence, healthcare and tax situation still need separate review.
A UK employee keeping a full-time remote role. The non-lucrative route does not authorise that work. The digital nomad route may be relevant if the foreign employer, remote-work permission, relationship history, professional qualifications, finances and social security arrangement meet the requirements.
A consultant with several foreign clients. This is professional activity, not a non-working profile. A self-employed digital nomad application may be possible, but existing client relationships and the real nature of the work need to be documented. Foreign invoices alone are not a complete application.
A shareholder who still runs the company. Ownership and active work are separate. A person who continues to direct operations should not assume dividends make the profile non-lucrative. The residence route, company structure and social security position need a coordinated review.
These are illustrations, not client case studies or promises of eligibility. They show why the first discussion should be about what you will actually do in Spain.
Why having large savings does not authorise work
The financial requirement establishes that you can support yourself. It does not expand the activities allowed by the residence authorisation. A person with substantial savings who intends to continue their job still needs a route compatible with working.
Similarly, paying Spanish taxes on employment income would not cure an immigration permission problem. Tax compliance, residence permission and social security compliance are distinct obligations. A correct tax return cannot retrospectively convert a non-working permit into a work permit.
When the digital nomad route may be appropriate
Spain’s international teleworker regime is aimed at qualified professionals working remotely through computer, telecommunications or similar means. Employees must work for companies outside Spain. Self-employed professionals may have Spanish activity within the statutory 20% limit, subject to the remaining conditions.
The foreign business must have real, continuous activity for at least one year. The applicant must generally demonstrate the relevant employment or professional relationship for at least three months before the application, remote-work compatibility, and the required qualification or professional experience. Sufficient financial means, criminal-record requirements and health and social security arrangements also apply.
Read our employer letter and supporting evidence guide before asking HR for a generic “work from anywhere” letter. An employer’s approval is necessary evidence for an employee, but does not by itself establish immigration eligibility.
Can you change from non-lucrative residence later?
There can be routes to modify residence status if the applicable conditions are met, but a future modification is not permission to work today. The timing, target authorisation and your individual circumstances must be assessed under the rules in force when you apply.
Do not start a new job on the assumption that an application or appointment automatically authorises it. Obtain advice about the legal effect of the specific procedure and when the relevant work permission begins. Equally, do not choose non-lucrative residence simply as a shortcut to a digital nomad authorisation.
What to disclose before choosing a visa
- Your present employment or professional contracts and whether you intend to continue them.
- Your actual duties, hours and clients, including any clients based in Spain.
- Company ownership and management roles, not only the dividends received.
- The income you would retain if you stopped working.
- Your employer’s willingness to approve Spain-based work and address social security.
- Your family members and intended move date.
Do not resign, restructure your company or convert to contracting purely to fit a checklist without employment, immigration and tax advice. A paper change that does not match the real relationship can create additional problems.
Use an activity inventory, not an income label
Before choosing a route, write down a normal working week as it would look after moving. Include client calls, invoicing, supervision, sales, marketing, content production, professional advice and administration. Then identify which tasks would stop and which would continue. This exercise is more informative than describing yourself as financially independent while still providing paid services every day.
Record the legal relationship behind each activity: employee, independent professional, company director, passive shareholder or property investor. One person can hold several roles at once. A pension does not make continuing consultancy disappear, and dividends do not settle whether you also work for the company. The application needs to reflect the combined reality, not only the income stream that appears easiest to document.
If you are uncertain about a task, describe the task itself to your adviser. For example, approving a business's daily operations raises a different question from receiving a shareholder statement. Do not assume that unpaid operational work is automatically harmless: the legal classification of the activity needs review. This article does not provide a blanket exemption for voluntary work, directorships or occasional business involvement.
Online businesses, royalties and rental operations
Digital income is not necessarily passive income. Maintaining an online shop, negotiating sponsored content, delivering a course with live support or servicing software clients can involve continuing professional activity. Automated payments are only the collection mechanism. The question is what work you perform to generate or maintain those payments while living in Spain.
Royalties illustrate why the facts matter. A payment relating to a previously created work may differ from fees for producing new material or delivering ongoing services. Identify the contract, the source of payment and your current obligations. A label such as royalty, licensing fee or distribution should not be used to hide an active service relationship. A mixed arrangement may require a detailed assessment rather than a simple yes-or-no category.
The same reasoning applies to property. Receiving rent through an independent management arrangement is not identical to personally operating short stays, handling guests and providing hospitality services. Ownership alone is not the answer. Describe the management tasks and any continuing business obligations, so that the assessment concerns the actual activity rather than the word rental on a bank credit.
Plan a genuine transition out of employment
If your intention is to stop working and live on non-working resources, identify when the employment ends, which obligations remain and what evidence supports the change. The relevant documents depend on the circumstances and consular instructions. A final employment letter, termination record or retirement entitlement may help explain the position, but there is no single universal resignation document for every US and UK applicant.
Check deferred payments separately. A final bonus, severance payment or payment for work already completed is not the same fact as continuing to perform services. Explain the period to which a payment relates and retain the supporting records. Do not ask an employer to describe continuing work as a past payment merely to improve the visa narrative.
Do not resign simply to follow this article. Employment rights, pension timing, household finances and immigration eligibility need coordinated advice. If you cannot support the move without continuing your job, the appropriate conclusion may be that a non-working route does not fit your plan. Honest route selection is more useful than attempting to force a working profile into a non-lucrative application.
Check the digital nomad option without treating it as automatic
A foreign remote role is a starting point for a digital nomad assessment, not an approval. Establish whether you are genuinely employed or self-employed, whether the duties can be carried out remotely, and whether the business and relationship satisfy the required history. Evidence of income cannot substitute for an eligible activity or a lawful social security arrangement.
For employees, the qualifying work is for companies outside Spain. The provision permitting limited Spanish professional activity applies to self-employed professionals; it is not a twenty-percent allowance to take a second Spanish employee role. A person with Spanish clients should describe the whole professional activity and obtain advice on the statutory limit rather than rely on a simplistic bank-receipts calculation.
Consider the location of the application as a separate question. A consular telework visa and a residence application from lawful presence in Spain are different procedures. A tourist visit does not itself grant permission to start the work. If you are already in Spain, confirm your lawful status, the available procedure and when the relevant permission takes effect before beginning or continuing an activity.
What if you already hold non-lucrative residence?
If you currently hold this authorisation and want to return to work, first identify the proposed activity and target permission. A modification or another residence procedure may be relevant, but eligibility, timing and legal effect must be checked for your circumstances. Do not presume that a general right to apply means a right to work immediately.
If you have already been working, obtain confidential legal advice and provide accurate facts. Keep the authorisation, contracts, dates and relevant correspondence. This guide cannot determine whether a particular breach has occurred, what consequences follow or which remedy is available. Avoid further concealment or backdated documentation: an accurate chronology is necessary for sensible advice.
Family members should not assume that the principal applicant's route gives everyone identical work rights. The particular family authorisation and legal framework matter. Conversely, a family member's separate work permission does not automatically expand the principal applicant's non-lucrative permission. Review each person's position before accepting employment or invoicing clients.
A practical route-selection conversation
Prepare three short summaries: the work you intend to do in Spain, the resources available if that work stops, and the evidence your employer or clients can provide. Add your family composition, intended application location and move date. This allows an adviser to test the routes against real facts rather than against a preferred visa name.
For a working profile, review the US and UK social security questions early. For a non-working profile, review financial evidence and health insurance without presenting work income as a permitted activity. The result may be a suitable route, an evidence gap that can be resolved, or a plan that needs to change. None of these conclusions should be replaced by a promise that every remote worker can obtain residence.
For the wider eligibility comparison, see our non-lucrative versus digital nomad guide. If you provide independent services, also distinguish freelance and digital nomad routes rather than assuming every self-employed activity fits international telework.
Official sources and a sensible next step
The Spanish consulate in London’s non-working visa guidance defines the route as residence without gainful work or professional activity. The non-lucrative requirements are governed by Royal Decree 1155/2024; the international teleworker route is set out in Law 14/2013, articles 74 bis and following.
For financial evidence without working, read how to prove funds for the non-lucrative visa. If your profile mixes work and passive income, ask Carway Migrate to assess the appropriate route before committing to an application. This is general information, not personalised legal advice.
